If You Have Been Served with a Protection Order
If you are served with a protection order, you have ten (10) business days to request a hearing on whether the protection order should remain in effect. With protection orders, your ability to parent your children, possess a firearm, be at your own house may be limited by the issuing court. I represent persons served with protection orders to either have the protection order dismissed or in other circumstances to remove minor children from a protection order so a parent can see his or her child(ren).
Protection Orders are usually set for a hearing within 30 days, so it is very important to have representation secured and the applicable evidence ready for the first hearing. There are complications with protection orders with corresponding criminal charges, so if you are charged with a crime and a protection order, you need to make sure that you have an attorney so you are not waiving your right against self incrimination in a protection order proceeding.
